Melissa Delgado, Assistant Public Defender, Law Office of the Cook County Public Defender

Details

Beyond Unmasking: Reading Between the Blue Lines takes a deeper look at how criminal defense attorneys can investigate, understand, and challenge law enforcement witnesses and the technology they rely upon. This presentation will provide practical strategies for uncovering and obtaining police misconduct and disciplinary records through FOIA and other sources, developing a theory of the law enforcement witness, and using misconduct evidence to challenge officer credibility through cross-examination. It will also examine law enforcement devices and systems, including body-worn and in-car cameras, Tasers, automated license plate readers, K9s, and mobile data computer systems, with particular attention to audit trails and the information these technologies can reveal. Attendees will learn how to look beyond the police report, identify additional sources of evidence, investigate the investigators, and turn information about officer history, credibility, discipline, and technology into effective motions, subpoenas, cross-examination, and defense strategies.
